About the Workshop

Learning Objectives
Rather than focusing solely on the conventional use of Scott Schedules by expert witnesses in dispute resolution, this workshop provides contract administrators with a broader and more practical perspective on the tool. The key learning points are as follows:
1. Effective Contract Administration
Scott Schedules serve as an effective method to document differences in the parties’ views and regarding their various claims — both during the contract period and the maintenance (defects liability) period. Beyond mere record-keeping, they optimise efficiencies by identifying differences in position between the contractor and contract administrator at an early stage, thereby promoting the efficient resolution of such works and, critically, supporting the avoidance of disputes through early settlement of conflicts.
2. Perspective from Expert Witnesses and Legal Counsel
Beyond contract administration, Scott Schedules serve as an important tool for expert witnesses and legal counsel should matters escalate to legal proceedings. Their perspectives also assist contract administrators to prevent disputes from arising. It also assists contract administrators in making fair and reasonable decisions in executing their roles and duties.
3. SOP Act Adjudications
Scott Schedules are increasingly used by adjudicators in SOP Act adjudications. Presentation in the form of a Scott Schedule assists the adjudicator with well-organised comparisons of the positions of various parties.
4. Arbitration Proceedings
Use of Scott Schedules are also commonplace in arbitration — often consolidating the key tenets of the contract administrator's decision through to expert witness opinion and legal counsel's arguments, in a credible and persuasive format before an arbitrator.
Workshop Format
The workshop is built around activities using a realistic construction scenario that runs from the construction stage through to dispute resolution on the merits. Activity #1 addresses the Scott Schedule from a Contractor and Contract Administrator viewpoint; Activity #2 from an Expert Witness and Lawyer/Counsel viewpoint; Activity #3 from an Adjudicator viewpoint; and Activity #4 from an Arbitrator viewpoint.
Faculty
Technical and expert-witness perspectives will be provided by Ar. Darren Benger. Accredited Construction Law specialist, Lawyer Chan Yong Neng, share perspectives from counsel. Former State Courts Judge, Professor Leslie Chew SC will provide review and feedback from a judge's perspective.
Who Should Attend
This workshop is applicable to all practitioners in construction and construction law, including contractors, consultants, contract administrators, experts, lawyers/counsel, adjudicators and arbitrators. Contract administrators — encompassing architects and engineers as primary administrators and quantity surveyors in a support capacity — will find this workshop directly relevant to their continuing professional development.

About the Facilitators

Ar. Darren Benger - Committee Member, APIEx; Managing Director, VivATA Singapore Darren received his Bachelor of Architecture degree with First Class Honours from the University of Adelaide, Australia in 1995, and registered with the Board of Architects, Singapore in 2001. In respect of architectural practice, Darren is also a Registered Inspector for fire safety, a Design-for Safety Professional/trainer and a Universal Design Assessor. Since 1996 Darren has resided in Singapore, and he is currently Managing Director of the architectural practice VivATA Pte Ltd and served as an elected member of the Board Of Architects, Singapore, for the 2023/24 term. Darren is also involved in the Singapore Institute of Architects, including election to Council from 2007 to 2021. He has actively participated in various SIA committees, including the Building Contracts Committee as well as the Architectural Practice Committee and ADR Committee (which he also chaired at various stages). Darren is listed on SIA's panels of Arbitrators and Expert Determinators. In respect of construction law and alternative dispute resolution, Darren served on the Council of the Society of Construction Law (Singapore), including as chairman for the 2014-15 term. Darren is also a Fellow of the Singapore Institute of Arbitrators, and attained the Graduate Certificate in International Arbitration from NUS in 2011. Darren has acted as an Expert Witness in various arbitration, litigation and strata-title-board matters. He is pleased and honoured to be elected to the APIEx Committee for the 2025/26 term. |

Mr. Chan Yong Neng - Partner, Pinsent Masons MPillay LLP Yong Neng is a construction advisory and disputes resolution specialist. He has advised on and acted in disputes across a wide range of infrastructure projects locally and internationally, including offshore wind farms, coal fired power stations, petrochemical refineries, process plants, rail lines and stations, tunnel boring projects, airport terminals and residential developments. His experience includes the resolution of costs and time claims arising from variations, unforeseen physical conditions, acceleration and prolongation of works, defects, non-compliance with contractual specifications and the termination of contracts. Yong Neng regularly acts in international commercial arbitrations and proceedings in the Singapore Supreme Court. He has also successfully represented clients as counsel and advocate in adjudications under the Singapore Security of Payments Act. He serves on Council of the Singapore Society of Construction Law and is an accredited specialist in Construction Law with the Singapore Academy of Law. |

Prof. Leslie Chew SC - President, APIEx; Dean, School of Law, Singapore University of Social Sciences; Consultant, Peter Low Chambers LLC Professor Leslie Chew, SC is a Consultant at Peter Low Chambers. With a prolific career spanning some 45 years of legal experience, Professor Chew has spent seven years in the judiciary as a Senior District Judge and has the distinction of being appointed Senior Counsel by the Supreme Court – Singapore’s equivalent of the Queen’s Counsel in England – in 2000. Professor Chew’s main practice area is at the Commercial Bar. Professor Chew is an Advocate & Solicitor of the Supreme Court of Singapore in 1981. He is also a Solicitor of England & Wales. Professor Chew is an accomplished commercial arbitrator and has practiced as an arbitrator and arbitration counsel since 1993. He has written on Medical Law, Arbitration and Technology. |
