About this Seminar\n
On 28 January 2026, Asia Pacific Institute of Expe
 rts (“APIEx”) and the Society of Construction Law (Singapore) (“SCL(S)”) wi
 ll jointly unveil a landmark initiative: the SCL(S) Protocol for the Use of
  Experts’ Joint Statements in Arbitration. \nThis event, chaired by Leslie 
 Chew SC, brings together distinguished panellists Darren Benger, Iain Potte
 r, and Kelvin Teo, to explore how this new Protocol will shape the way expe
 rt evidence is presented and understood in arbitration proceedings. The imp
 ortance of this initiative was underscored at the recent SCL(S) Annual Conf
 erence in September 2025, where Justice Philip Jeyaretnam, President of the
  SICC, highlighted the critical role of expert witnesses in assisting the d
 ecision-maker in complex disputes. He cautioned against “ships passing in t
 he night”—experts speaking past one another without a common dataset—and em
 phasised the need to avoid adding costs without clarity. His observations r
 esonate strongly with the aims of the Protocol: to avoid wasted time, unnec
 essary costs, and fragmented evidence, whilst promoting a level playing fie
 ld and enhancing efficiency. The Protocol therefore responds to an observab
 le need in both Singapore domestic arbitration and Singapore-seated interna
 tional arbitrations for the effective management of joint expert evidence. 
 \nAt its core, the Protocol is designed to facilitate collaboration between
  experts so as to provide practical guidance to assist all stakeholders in 
 arbitration —tribunals, counsel, and experts alike. This launch event promi
 ses to offer participants a first gaze into the crystal ball for how the Pr
 otocol may establish best practice for expert collaboration in arbitration,
  with a view to further strengthening Singapore’s reputation as a hub for e
 fficient, fair and principled dispute resolution. We are therefore most ple
 ased to have this esteemed panel of senior practitioners provide their insi
 ghts, with a focus on real-world application of the Protocol.\nParticipants

Ar. Darren Benger - Committee Member, APIEx; Managing Director, VivATA 
 Singapore\n
Darren received his Bachelor of Architecture degree with First 
 Class Honours from the University of Adelaide, Australia in 1995, and regis
 tered with the Board of Architects, Singapore in 2001. In respect of archit
 ectural practice, Darren is also a Registered Inspector for fire safety, a 
 Design-for Safety Professional/trainer and a Universal Design Assessor. Sin
 ce 1996 Darren has resided in Singapore, and he is currently Managing Direc
 tor of the architectural practice VivATA Pte Ltd and served as an elected m
 ember of the Board Of Architects, Singapore, for the 2023/24 term. Darren i
 s also involved in the Singapore Institute of Architects, including electio
 n to Council from 2007 to 2021. He has actively participated in various SIA
  committees, including the Building Contracts Committee as well as the Arch
 itectural Practice Committee and ADR Committee (which he also chaired at va
 rious stages). Darren is listed on SIA's panels of Arbitrators and Expert D
 eterminators. In respect of construction law and alternative dispute resolu
 tion, Darren served on the Council of the Society of Construction Law (Sing
 apore), including as chairman for the 2014-15 term. Darren is also a Fellow
  of the Singapore Institute of Arbitrators, and attained the Graduate Certi
 ficate in International Arbitration from NUS in 2011. Darren has acted as a
 n Expert Witness in various arbitration, litigation and strata-title-board 
 matters. He is pleased and honoured to be elected to the APIEx Committee fo

Iain Potter is a Chartered Accoun
 tant, qualified in both the UK (ICAEW) and Singapore (ISCA), specialising i
 n complex loss of profit and valuation engagements and he has been based in
  Singapore since 2014. Iain is recognised as a leading expert by Who’s Who 
 Legal, with clients praising his "matter-of-fact approach to drafting repor
 ts and giving testimony", adding that "He is a fantastic expert witness for
  quantum, valuation and forensic accounting." Outside of his expert appoint
 ments, Iain is a member of the adjunct faculty at the National University o
 f Singapore’s Business School, where he lectures on damages quantum and bus
 iness valuation disputes. He is also pursuing a number of lines of research
 , currently including a PhD focusing on the extent to which awards of damag
 es reflect risk and uncertainty.\n

Kelvin specialises in reso
 lving complicated infrastructure, energy and resource disputes. Kelvin’s pr
 actice focuses on renewable energy projects and sustainability. His sector 
 expertise covers a variety of renewable projects such as solar, offshore wi
 nd, hydropower and geothermal projects. Kelvin’s experience also covers nuc
 lear power plants, refineries, mines, railways and expressways; civil works
  such as buildings, factories, soil remediation and foundation works, and e
 ven giant Ferris wheels. His practice includes advising on documentation fo
 r such projects. He has advised parties and projects in Singapore, France, 
 Korea, Greater China, Taiwan, Middle East, Mongolia, Taiwan, Italy, Laos, P
 hilippines, Indonesia, Malaysia, Thailand, Vietnam, US, Italy, and India, a

Professor Leslie Chew, SC is a Con
 sultant at Peter Low Chambers. With a prolific career spanning some 45 year
 s of legal experience, Professor Chew has spent seven years in the judiciar
 y as a Senior District Judge and has the distinction of being appointed Sen
 ior Counsel by the Supreme Court – Singapore’s equivalent of the Queen’s Co
 unsel in England – in 2000. Professor Chew’s main practice area is at the C
 ommercial Bar. Professor Chew is an Advocate &amp; Solicitor of the Supreme
  Court of Singapore in 1981. He is also a Solicitor of England &amp; Wales.
  Professor Chew is an accomplished commercial arbitrator and has practiced 
 as an arbitrator and arbitration counsel since 1993. He has written on Medi
 cal Law, Arbitration and Technology.\n
