On 28 January 2026, Asia Pacific Ins
titute of Experts (“APIEx”) and the Society of Construction Law (Singapore)
(“SCL(S)”) will jointly unveil a landmark initiative: the SCL(S) Protocol
for the Use of Experts’ Joint Statements in Arbitration.
This event,
chaired by Leslie Chew SC, brings together distinguished panellists Darren
Benger, Iain Potter, and Kelvin Teo, to explore how this new Protocol will
shape the way expert evidence is presented and understood in arbitration pr
oceedings. The importance of this initiative was underscored at the recent
SCL(S) Annual Conference in September 2025, where Justice Philip Jeyaretnam
, President of the SICC, highlighted the critical role of expert witnesses
in assisting the decision-maker in complex disputes. He cautioned against “
ships passing in the night”—experts speaking past one another without a com
mon dataset—and emphasised the need to avoid adding costs without clarity.
His observations resonate strongly with the aims of the Protocol: to avoid
wasted time, unnecessary costs, and fragmented evidence, whilst promoting a
level playing field and enhancing efficiency. The Protocol therefore respo
nds to an observable need in both Singapore domestic arbitration and Singap
ore-seated international arbitrations for the effective management of joint
expert evidence.
At its core, the Protocol is designed to facilitate
collaboration between experts so as to provide practical guidance to assis
t all stakeholders in arbitration —tribunals, counsel, and experts alike. T
his launch event promises to offer participants a first gaze into the cryst
al ball for how the Protocol may establish best practice for expert collabo
ration in arbitration, with a view to further strengthening Singapore’s rep
utation as a hub for efficient, fair and principled dispute resolution. We
are therefore most pleased to have this esteemed panel of senior practition
ers provide their insights, with a focus on real-world application of the P
rotocol.

Programme
Darren received his Bachelor of Architecture deg ree with First Class Honours from the University of Adelaide, Australia in 1995, and registered with the Board of Architects, Singapore in 2001. In re spect of architectural practice, Darren is also a Registered Inspector for fire safety, a Design-for Safety Professional/trainer and a Universal Desig n Assessor. Since 1996 Darren has resided in Singapore, and he is currently Managing Director of the architectural practice VivATA Pte Ltd and served as an elected member of the Board Of Architects, Singapore, for the 2023/24 term. Darren is also involved in the Singapore Institute of Architects, in cluding election to Council from 2007 to 2021. He has actively participated in various SIA committees, including the Building Contracts Committee as w ell as the Architectural Practice Committee and ADR Committee (which he als o chaired at various stages). Darren is listed on SIA's panels of Arbitrato rs and Expert Determinators. In respect of construction law and alternative dispute resolution, Darren served on the Council of the Society of Constru ction Law (Singapore), including as chairman for the 2014-15 term. Darren i s also a Fellow of the Singapore Institute of Arbitrators, and attained the Graduate Certificate in International Arbitration from NUS in 2011. Darren has acted as an Expert Witness in various arbitration, litigation and stra ta-title-board matters. He is pleased and honoured to be elected to the API Ex Committee for the 2025/26 term. | |
| Mr. Iain P otter - Committee Member, APIEx; Executive Vice President, J.S. Held LLC Iain Potter is a Chartered Acco untant, qualified in both the UK (ICAEW) and Singapore (ISCA), specialising in complex loss of profit and valuation engagements and he has been based in Singapore since 2014. Iain is recognised as a leading expert by Who’s Wh o Legal, with clients praising his "matter-of-fact approach to drafting rep orts and giving testimony", adding that "He is a fantastic expert witness f or quantum, valuation and forensic accounting." Outside of his expert appoi ntments, Iain is a member of the adjunct faculty at the National University of Singapore’s Business School, where he lectures on damages quantum and b usiness valuation disputes. He is also pursuing a number of lines of resear ch, currently including a PhD focusing on the extent to which awards of dam ages reflect risk and uncertainty. |
| Mr. Kelvin Teo - Director, Drew & Napier LLC; Cou ncil Member, SCL(S) Kelvin specialises in resolving compli cated infrastructure, energy and resource disputes. Kelvin’s practice focus es on renewable energy projects and sustainability. His sector expertise co vers a variety of renewable projects such as solar, offshore wind, hydropow er and geothermal projects. Kelvin’s experience also covers nuclear power p lants, refineries, mines, railways and expressways; civil works such as bui ldings, factories, soil remediation and foundation works, and even giant Fe rris wheels. His practice includes advising on documentation for such proje cts. He has advised parties and projects in Singapore, France, Korea, Great er China, Taiwan, Middle East, Mongolia, Taiwan, Italy, Laos, Philippines, Indonesia, Malaysia, Thailand, Vietnam, US, Italy, and India, amongst other s. Kelvin is a Fellow of the Singapore Institute of Arbitrators and sits as an arbitrator, and has recently been recognised as a leading arbitration p ractitioner in The Legal 500 Arbitration Powerlist: Southeast Asia. He enjo ys carrying out advocacy across the entire spectrum of dispute resolution - arbitration, adjudication, mediation, expert determination and evaluation, and litigation, both within and out of Singapore. Kelvin has been recognis ed by a number of legal directories for his expertise in construction and a rbitration. He is also a thought-leader on construction law and arbitration practice issues and sits on a number of professional bodies and panels. |
| Prof. Leslie Chew SC - Presi dent, APIEx; Dean, School of Law, Singapore University of Social Sciences; Consultant, Peter Low Chambers LLC Professor Leslie Chew, SC is a Consultant at Peter Low Chamber s. With a prolific career spanning some 45 years of legal experience, Profe ssor Chew has spent seven years in the judiciary as a Senior District Judge and has the distinction of being appointed Senior Counsel by the Supreme C ourt – Singapore’s equivalent of the Queen’s Counsel in England – in 2000. Professor Chew’s main practice area is at the Commercial Bar. Professor Che w is an Advocate & Solicitor of the Supreme Court of Singapore in 1981. He is also a Solicitor of England & Wales.
