Webinar Synopsis

The new Rules of Court which will take effect from 1 April 2022 stipulate as a general rule that “as far as possib le”, parties must agree on one common expert”.  This procedural change envi sages a new Single Joint Expert (“SJE”) that has already b een well recognised in other leading jurisdictions.

Considering past judicial critiques on a few expert battles t hat saw more heat than light, will this new hybrid result in a new type of expert that trumps all other experts? Will this in turn lead to a new balan ce in litigation that cures the mischief underlying this reform in the civi l justice reform reports heralding this change? What happens if one party w ishes to challenge an SJE’s report? Related to that, practical questions ar ise for consideration on how the new procedure and process is likely to wor k (including modalities for questioning in court).

To illuminate concept and share practical tips on the new “com mon expert” or single joint expert, an expert panel comprising lawyers as w ell as experts who have acted as SJEs outside Singapore will share their in sights and wisdom with attendees.

Mr. John Battersby - Group Managing Director, BKAsiaPacific Limited, Hong Kong

Mr. John Battersby, FCInstCES, FGIS, FASI, FCIOB, FHKI CM, MRICS, MHKIS, FCMI, FCIArb, FHKIArb, MAE, RPS(QS) is Group Managing Dir ector of BKAsiaPacific Limited and a Registered Professional Quantity Surve yor (Hong Kong) and Chartered Construction Manager having worked in the con struction industry for 54 years, 38 years of which have been spent working on projects in Hong Kong, China and South East Asia. John has acted as an e xpert witness several times, both in arbitration and litigation, in respect of additional cost/loss and expense/damages claims, measurement issues, ad justment of rates, valuation of variations and causes and effects of delays to construction works.  He has acted both as party appointed expert and “s ingle joint expert” (or “tribunal expert”).  He is a Practising Member of t he Academy of Experts and accredited by the Academy as an Expert.  He has a lso been appointed as Arbitrator, Assessor, Adjudicator, Mediator and Dispu te Resolution Advisor several times. From his first hand experience of what can go wrong on various building and civil engineering projects, John unde rstands the importance of dispute avoidance through collaborative/cooperati ve contracting.  He has also worked on target cost contracts utilizing coll aborative/cooperative working procedures as well as NEC lump sum and measur ement contracts and has conducted numerous seminars and workshops on these subjects.

 

Mr. Chan Leng Sun SC - S enior Counsel and Chartered Arbitrator, Duxton Hill Chambers, Singapore

Leng Sun is a Senior Counsel of the Supreme Court of S ingapore and a Chartered Arbitrator practicing with Duxton Hill Chambers. H e is a member of the Singapore International Arbitration Centre Court of Ar bitration and the ICC Commission on Arbitration and ADR. He is formerly the Global Head of Arbitration of an international law firm and President of t he Singapore Institute of Arbitrators (SIArb). He is the Deputy Chairman of the SGX Appeals Board. Leng Sun is quali fied in Malaysia, Singapore and England. He has a broad commercial practice and has acted as counsel or sat as arbitrator in arbitrations seated in As ia, Europe and USA under ad hoc and institutional rules. Leng Sun had also served as a legal officer of the United Nations Compensation Commission in Geneva. Leng Sun was a lecturer at the Na tional University of Singapore Law School from 1990 to 1993. He started and taught the Arbitration course in the Singapore Management University Law S chool as an adjunct in 2009 and 2010. Leng Sun is the author of the book, S ingapore Law on Arbitral Awards and Co-Editor of Conflict of Laws in Arbitr ation. Leng Sun is recognized among the t op lawyers worldwide by legal directories, such as "Who's Who Thought Leade rs – Litigation 2022", "Who's Who Legal - Arbitration 2022” and Acritas Sta rs 2021. He is described by WWL as being “amon g the very best disputes lawyers in the world” and lauded as on e of ALB Asia’s Super 50 Dispute Lawyers, which reported him to be “spectacular, with exceptional knowledge and depth of insight”.

 

Mr. Graham Cooper - Principal Associate, Hawki ns & Associates, Singapore

Graham obtained his first degree in Materials Technology from Coventry Polytechnic and his Masters degree in Advanced Materials Tec hnology from the University of Surrey. He has been a Chartered Engineer sin ce 1991 and is a Professional Member of the Institute of Materials, Mineral s & Mining. After graduation, he spent 10 years with British Aerospace where he was primarily involved with materials development, manufacturing s upport and aircraft defect investigation. He went on to work for British Ai rways in 1995 as their company metallurgist and defect investigation specia list before joining Burgoynes in 1998. Graham has investigated over 500 mec hanical and materials related cases including aircraft accidents and incide nts, marine accidents and losses, road traffic accidents, rail accidents, o il and gas production and pipeline incidents, industrial process plant inci dents and power generation turbine failures. He has previously worked in Si ngapore and has undertaken investigations in the UK, Ireland, Europe, South Africa, Middle East, Far East and Australia. He has acted as an Expert Wit ness and Single Joint Expert in litigation cases and has given expert evide nce in civil and criminal court cases, arbitrations and mediations. Graham joined our Leeds office as a Principal Associate in August 2014, and is now based in our office in Singapore.

 

Ms. Suzanne Delbridge – Director, Delbridge Forensic Accounting, Austr alia
Suzanne is a Director of Delbridge Forensic Accou nting, and is a Fellow of Chartered Accountants, Australia and New Zealand. Suzanne specialises in the valuation of equity and businesses of all sizes , the investigation of transactions and quantification of losses, and the s tructuring of settlements to achieve effective outcomes. The Newcastle base d practice headed by Suzanne completes work all over Australia, primarily f or the purpose of litigation, with a particular interest in the Family Law jurisdiction. Suzanne is regularly retained as an expert witness in propert y proceedings before the Federal Circuit Court and Family Court of Australi a and the Family Court of Western Australia. Suzanne has been retained as a single expert witness since the introduction of those rules in the Family Law jurisdiction in Australia in 2004. Suzanne is also retained for the pur pose of commercial proceedings before the NSW Supreme and District Courts a nd other dispute resolution forums. Suzanne is a regular writer and present er of education on topics relevant to lawyers and accountants, particularly in the areas of business valuation and forensic accounting generally.

Greg ory’s present practice encompasses a specialisation in banking and corporat e insolvency as well as litigation, arbitration and mediation of commercial disputes and chancery matters. He is also a recognised expert in charities governance and has given expert witness testimony for overseas court proce edings. Gregory graduated from the National University of Singapore in 1992 , was admitted to the Singapore Bar in 1993 and joined Rajah & Tann LLP after being in practice in two other leading law firms for 15 years (joint ly heading the Banking and Insolvency Litigation Practice group of another leading law firm). Gregory was appointed Senior Counsel in 2019. Gregory pr esently serves as Immediate Past President of the Law Society. He has also been appointed as a Fellow of the Insolvency Practitioners Association of S ingapore, the Singapore Institute of Arbitrators and the Singapore Institut e of Directors.
